There really is no right answer I think. IMO, this all depends on what your setting is like. Some settings might have hedge wizards selling cheap wands and staves on every street corner. Even if you wanted to look at is as just "energy", I would still draw the same conclusion based on the wording in the PHB. A 1st level wizard casts MM and it does a certain amount of damage right? But a higher level wizard casts the same spell and does more damage. Using your view, I would...

My preference for scrolls matches my preferences for wands. The power level of the scroll spell is determined by the level of the creator of the scroll. Sounds like the reasonable solution is for the CK to assign a caster level to any spell-based item and call it good. The CL would designate the spell effect (duration, damage, area,etc).
