Fathers Don't Let Your Children Grow Up To Be... Canadian!
Surfing about on the usual forums, and I discovered this little gem of comedy. I'm not making a political statement, but passing along a court ruling that is so bizarre that it has to be shared. If something like this were passed in the US, I'd expect a national splurge of like-minded individuals using it as a precedent, but Canada, especially Quebec, is a little different -- for one, the province uses its own legal system (or, one that is not quite like the rest of Canada, based on Napoleonic code.) Anyway... I found it quite interesting, and it just makes my head race with conspiracy theories. Enjoy!

As a Canadian... and someone residing within Quebec, I feel I should point or at least clarify a few things.
Robert is indeed correct... the provincial law (think of it like 'State' law) is based on the Napoleonic code which is due to Quebec's roots to the French.
While this is a most unusual case, like most cases, a large part of this can be decided upon some sort of precedence. In this case though, it seems more of a tangled mess of custody and divorced parents. What was most likely the deciding factor was a parent's authority being overturned by the other. At least that is what I assume was one of the key factors. Of course, this is quickly turning into something of a farce and a mess which would have me question the abilities of some of the lawyers and the judge presiding in this case.
In the event that it gets taken up a notch to the Supreme court of Canada (ie... the Federal level). Then the argument could come down to a question of the Charter of Rights and Freedoms in Canada but in that event, it would quickly be shot down.
But this thing is pretty messed up and someone, somewhere, needs a good boot to the head!

That reminds me of the story told to me by a very close friend from Moncton about a New Hampshire woman who when told she had to pay the VAT (Value Added Tax) exclaimed, "Why should I have to pay that here? I don't at home." When told the story, the answer I gave was very simple: that's disrespectful. You are in a different country and you are subject to their laws while there. If she didn't like it, then she should get the f*** out.
Quebec? Even Canadians say they should get the f*** out. That link you posted only highlights why, because the rest of Canada wouldn't have such bad comedy.

Wow, what a messed up situation! That should have never, never, never gone go court. Obviously, the judge doesn't have the guts to throw it out. This is a matter that should be taken care of between the parents. Granted they are seperated/divorced, but they are the one's to tackle this situation. Also, the lawyer who took up the daughter's case should be shot, or at least as someone else wrote, kicked in the head a few thousand times. What a crock of sh*t that whole fiasco is!

Actually, this case could have easily happened anywhere else in Canada. The reason it went anywhere is a different matter. If a terrible lawyer on the side of the defense failed to prove their case... or the other lawyer was just that damned good means that a justice system based on a model of arbitration is not perfect.
Just take a look at some of the high profile cases that have happened in the States and can anyone tell me, that some of those aren't equally messed up?
As for the political statement that might be implied by the above quote, my roots are actually French Canadian and I believe in a united Canada. The issue is a lot more complex but still quite political. We should leave it at that.

Oh... the song was nominated for an academy award (I believe) and he performed it for the show.
If it wasn't the academy awards, then it was something similar like the golden globes.

How about the dude that was arrested for sleeping in the middle of the left turn lane. Later found to have contraband in his car and set free because it was an illegal search - due to the fact that the police had no right to search his car... apparently sleeping while driving is NOT a suspicious act.
